(PRINCE KOLAM) King Of The Underworld [Past][HE Died]

The king of Colombo under world, "Prince" who had heavy political influence was shot dead last night in one of his houses in Bluemandal, Colombo 13.

He apparently owned several houses in Colombo and he had been watching the finals at his house in Bluemandal and fallen a sleep half way of the match. His body guards had also fallen asleep after getting drunk and then an unidentified group of armed men who arrived at the house had carried out the shooting.

Prince gained his under world authority after the last presidential election through his affiliations with some politicians and even killed a former underworld king Nawala Nihal and all three of his brothers.

Several valuable lands in Colombo were transferred to the underworld members through his influence and the recent collection of ransom worth 5 million rupees from a businessman in Kiribathgoda had also taken place with his intervention.

Reports from the under world in Colombo say that "Prince" was assisted in his ventures by a government minister and his son.

Prince associate killed
Dinesh C. Dushanta (30) an associate of murdered under world king pin Prince was killed by an unknown gang at the rail tracks near Bloemendhal Road yesterday.

Assailants, according to the Modara Police, shot Dushanta early morning around 4.10 a.m. Police sources said he had been shot 32 times.

Investigations are currently underway to find the killers.

The notorious gangster Wambotta and an accomplice were shot dead on Sunday night at Aswatte in Kosgama while travelling in a Dolphin van from Seeduwa to Avissawella, police said.

They said two others who were in the van which was driven by Wambotta were injured while two other gangsters were arrested.

The dead gangsters were identified as Kitulgamaralalage Ajit Wasantha alias Wambotta and Sumeda Priyankara Saman of Suriyawewa.

Sabaraganmuwa DIG Neville Wijesinghe said that in December Wambotta had been arrested at Avissawella by the police while the gang leader was with his mistress.

The DIG said since his release after two months in jail, Wambotta was residing at Avissawella till he was ambushed and killed by another underworld gang on Sunday.

Police said they found 60 spent cartridges at the scene of the crime.

Tangalle District Crime Bureau sources said some time ago three of Wambotta’s sisters were allegedly raped, tortured and killed by a rival family. This had led to a series of revenge killings with more than 25 of the rival family members being killed and their property destroyed.

Police said the gang led by Wambotta was also wanted for ten other killings and some 20 cases of extortion the most recent being the incident at Hambantota where a mudalali was abducted.

Many of the underworld leaders, who were opposed to Vambotta now fear that they would be the target of revenge killings by what remains of his gang, while those who had no grouse against him fear that they could be targeted by other seeking to take complete control of the underworld now that the feared Vambotta is out of the way.

A member of the Vambotta’s gang who was seriously injured in the shooting was admitted to the Homagama Hospital.

Two other persons who were travelling with Vambotta were unhurt although the pursuers had used automatic rifles to riddle the underworld figure’s body with bullets, police said.

Vamb-otta who had started life selling vegetables in the Sooriya-wewa weekly fair had later joined the notorious gang of Ratnaweera who was a suspect in a large number of extortions, robberies and murders and remained with the gang for sometime but later left it to form his own gang, police said.

When Southern Provincial Councillor Chandimalli was killed by the Ratnaweera Gang in front of the CID headquarters, Colombo Ratnaweera was arrested as a suspect and was remanded.

Ratnaweera too was gunned down by the Vambotta gang who held up the prisons vehicle at Ridiyagama when he was being taken to courts by the prison officers. Ratnaweera and a prisons officer were killed.

Vambotta was remanded as a suspect in the case and it was only one and a half months ago that he had been released. On Sunday Vambotta with some others including the person who was seriously injured had come to Negombo and were returning to Sooriyawewa but had come to Kosgama police area when a van in which his assailants travelled had opened fire on Vambotta’s van killing him almost instantaneously, police said.

The gang rivalry between Vambotta and Ratanaweera had claimed the lives of a number of people before each gang leader also was gunned down by gang members police said.

Wambotta gang kills four at funeral house

An armed gang of twelve clad in military fatigues stormed a funeral house at Vithanrandeniya, Beliatte in the wee hours of yesterday, killed four family members of the deceased, pumped bullets into the coffin and disappeared into the darkness of night.

The victims were two brothers and two sisters of A. Dharmadasa, who was involved in the killing of Army Jine, the notorious criminal from the south, at the Matara General Hospital.

Dharmadasa was gunned down while in hiding, three days ago by the Wambotta gang, which Army Jine belonged to.

The Wambotta gang, the police say, was behind yesterday’s incident as well.

The victims were A. Wimalasena, A. Ajithpriya, A. Leelawathie and A. Chandrani. An aunt of Dharamdasa was also hospitalised with gunshot injuries.

The gang, eyewitnesses said had dragged the two brothers first and shot them dead. Then they had returned and taken the two sisters and shot them, too.

There had been only a few people in the house at that time.

A police team led by OIC Beliatte Pradeep Wettasinghe rushed to the scene but the gang had left.

Two daughters of the brother of the person now in remand prison over Army Jine’s killing were abducted and raped a few months ago by the Wambotta gang.

Two members of the Wambotta gang responsible for the rape were later abducted, tortured and killed. Their bodies were found with their genitals blasted.

The Wambotta gang, according to sources, consists of over 50 heavily armed military deserters as well as soldiers and enjoys political patronage, which makes it extremely difficult for the police to make any arrests.

The Beliatte police are conducting investigations into yesterday’s incident under the directions of DIG (Southern Range) D. W. Prathapasinghe, and SSP S. K. Sugathadasa.

Army-Suranga and Wambotta group

Last week's court proceedings at the Embilipitiya Magistrate Courts began on a subdued note as usual with the Interpreter Mudaliar calling out the names of witnesses, accused and complainants gathered before court to testify.

The court house was packed to capacity and a busy atmosphere prevailed as usual. Several important cases were to be taken up that day and lawyers too were busy perusing their briefs to prepare for court battles.

Notorious criminals like Army-Suranga and other dangerous criminals from the break away Wambotta group were brought from far away prisons to testify before Embilipitiya magistrate. They were escorted to court premises by armed Prison officials and detained in a cell.

The remand prisoners and those who were already serving jail sentences were involved in other serious crimes like murder, robberies, rape, pillage etc. Security arrangements at the court premises were as usual with the presence of a few armed policemen and Prison officials.

But there wasn't any information received by police or Prison authorities that there was an impending attack on the court house. There weren't any ominous signs to foretell the impending attack.

There were no reasons whatsoever for police or Prison officials to panic and feel apprehensive about security arrangements.

No one ever imagined that a grenade would be lobbed at the remand cell to seek the release of Wambotta's henchmen or to destroy his enemies like Army-Suranga and his henchmen, the break away group. But the least expected happened while the court proceedings were on.

The time was around 11.10.a.m. when someone hurled a hand grenade at the remand cell. A Prison officer along with three persons died instantaneously while 36 persons were injured. Several ducked for cover under tables and there was total pandemonium and chaos in the court house.

Meanwhile Army-Suranga and 24 other hardcore criminals broke the remand cell and escaped for good. Who could have thrown a grenade at the remand cell amid tight security and from where did the hand grenade come from? These are some of the questions that the CID sleuths are investigating.

Following the jail break, a countrywide man hunt for the arrest of hardcore criminals was launched by IGP Chandra Fernando. A team of CID officers were despatched on the following day from Colombo to hunt down and arrest dangerous criminals who were at large.

Meanwhile on receipt of information that the jail breakers were seen roaming about in a car in the Sevenagala area, DIG, Uva Range, S.K. Shankar, was galvanised into action. He promptly ordered Inspector Kalansiri, OIC Uva Vice, Crime and Operations division to arrest the hard core criminals. Inspector Kalansiri. SI Herath, Sergeant Palitha and party lost no time and proceeded to Uda Walave - Sevenagala border by car on the subsequent day.

They were tipped off by an informant that Sujith Wasantha Kumarasinghe alias Army Suranga, A. Gamage Sarath Bandu and Marappulige Ruwan Pushpakumara, all army deserters and hardcore criminals that operated with the dreaded Wambotta's gang were seen going about in a Nissan car. They were wanted in connection with several contract killings, robberies and looting cases rape etc.

Having arrived at the Uda Walave border the police party alighted from their vehicle and trudged along a jungle path for nearly two kilo meters until they arrived near a cemetery.

The three fugitives who were unarmed were confronted by Inspector Kalansiri, SI Herath and the police party around 1.30. P.M. near the cemetery. When challenged by the police the fugitives gave up without a fight. They even begged for mercy and pleaded with the police not to be harmed.

Later Army Suranga had told Inspector Kalansiri that the grenade was lobbed by Wambottas gang to liquidate him and his colleagues in the cell. But subsequent investigations by Inspector Kalansiri had revealed that Wambottas gang had lobbed the hand grenade to get remand prisoner Nalin Suranga released so that he can assassinate one Abyenayake. Police found the pin of the hand grenade in the court premises.

The three criminals were later handed over to the Wellawaya Police Station and the CID sleuths are investigating them. Meanwhile the Commissioner General of Prisons Rummy Marzook is conducting a separate investigation about the incident.

Wambotta's affidavit

A police statement was recorded from Wambotta at the Crimes Division Western Province (North) in Peliyagoda on January 6, 2005 at 10.30 a.m. following his arrest by Peliyagoda Police.

After being detained he was subjected to intense interrogation after which ASP Priyantha Jayakody had instructed WPC 4344 Hemamali to type out the suspect's statement.

According to ASP Jayakody the reason why the statement was recorded was because of the incidents of murder, robbery and extortion that had taken place in the southern region in the recent past for which Wambotta is a prime suspect and wanted man.

Wambotta was born in Embilipitiya. His father was a vegetable vendor. He says that when he did not go to school the teacher would ask the other children in the class why he was absent and a girl named Ajantha once replied that "Wambotta" was selling vegetables at the pola. From that day, he says everyone called him Wambotta.

In 1993, he joined the army, enlisting as a member of the 3rd Sinha Regiment. He says he trained for two and a half months at an army camp in Nuwara Eliya where he was taught to use a weapon. He then ran away and returned to the vegetable selling business. In 1994, he married Sriyani Jayamanne.

After marriage he says he began to bring mung beans from Sooriyawewa in lorries, which he sold in Colombo. Hidden among the mung beans he claims to have smuggled marijuana which he handed over to a woman near Manning Market at Wellawatte.

He says while he earned a lot of money from those sales he finally got caught in Hambantota, for which a case is still being heard and there was a warrant issued for his arrest.

He however came out on bail and continued his mung bean business from which monies he bought a van which he put out on hire to operate near the Galadari Hotel. After a while he says he bought a new sports car. He took this car to the village where he proudly drove it around. But, he says in his statement that he was then summoned by Arthur Rathnaweera who lived in Sooriyawewa and told that nobody could be allowed to drive a better car than what the Rathnaweeras owned and he was ordered to sell it.

Swore revenge

Wambotta claims he did not do so after which he was again summoned to the Rathnaweera house. When he went there he says "two big black boys took me to a dark room and tied my hands. Arthur Rathnaweera put a 9mm pistol to my head and said, no one has tried to go above us. You didn't do as we asked. If you don't sell the car we will shoot you like a dog and kill you." Then Wambotta claims Arthur Rathnaweera took a steel lid nearby heated it on a gas cooker and burnt his left leg with it.

"I decided then and there that I would kill him someday," he says in his statement, adding as far as he can remember this incident took place in 1999 or 2000. "I hid in the jungles for sometime. Neighbours brought me food while I remained in the jungle in hiding," he says.

One day, he recounts how he took a knife and went to the Rathnaweeras' shop where he stabbed Arthur Rathnaweera two or three times. But while he was stabbing him he says the knife bent in two and he threw it away and ran back into the jungle to hide.

Thereafter he says he met a person who worked in the Sri Lanka Air Force who he approached to get him a weapon. By this time he states the Rathnaweeras in their failed attempt to find him had shot dead his sister Leelawathi's husband, Wimalasena.

Wambotta says, "My need for revenge grew after that. Once again I told the person who worked at the Ratmalana air base to find me a weapon as soon as possible. He was about 30 years old and about six feet tall. He had been shot in the left eye and was partially blind. One day when I met him he told me that if I gave him Rs. 80,000 he would give me the weapon."

Wambotta claims he then called someone in his village and got down the money. Questioned on how he got the money to pay for the weapon he states that his elder brother Saman sold his tractor and gave him the cash.

He asserts that he then went to the air force camp in Ratmalana and paid for a T-81 weapon. He claims he stuffed the weapon into his shirt, ran along the roads, jumped into a threewheeler and went all the way to Moratuwa using by lanes. He then says he got onto a night bus to Kataragama and went to Sooriyawewa.

"I realised this was a weapon used by air force personnel. I bought it to kill the Rathnaweera brothers. I went to the jungle and hid with my weapon. I hid like that and then one day I shot the Rathnaweeras' third brother in front of the Sooriyawewa garment factory. Although I searched for the other Rathnaweeras after that, I could not find them."

It is at this stage Wambotta says, " I hid out at Southern Provincial Councillor Chandi's house. I helped him and also Mahinda Rajapakse who I met through him, on their election work."

'Rathnaweeras got Chandi"

Chandi Malli was subsequently murdered outside the offices of the Criminal Investigations Department (CID) at York Street, Fort. According to Wambotta he claims it was the Rathnaweeras who got Chandi Malli killed.

Recalling the murder of Chandi Malli he says, "during this time I was in Mr. Mahinda Rajapakse's house. I gave my T-81 weapon to Suranga. Army Suranga was a person from our village. I gave the weapon to him for safekeeping. But then because he was robbing and using my name to do it, I moved away from him. I took the T-81 from Suranga and gave it to Sudu Malli in Mahaweli. But Army Suranga had gone to Sudu Malli and told him that I wanted the weapon and taken it from him. Army Suranga has now been caught stealing and is in remand."

The more contentious part of this statement then emerges in the last two pages. According to the statement in our possession questions have been raised by police on why and how Wambotta had phone numbers of both police officers and politicians, including that of the Prime Minister and Speaker of Parliament.

Wambotta allegedly responds that he kept the phone number of Temple Trees to contact the Prime Minister if the need arose. A phone number, which is not one for Temple Trees but for a telephone at Visumpaya.

More numbers

In relation to Speaker W. J. M. Lokubandara, Wambotta's statement states, "I do not recall how I got this number. I have never met or spoken to the Speaker." For Lokubandara, Wambotta's diary carries contact number 0112777383.

Lokubandara's number in Parliament is 0112777222. This number, 0112777383 is for the library in parliament.

Another entry is for the OIC Colpetty, Siriwardena, 0773060125. Wambotta's statement says, "This number was given to me by a former police officer attached to the Presidential Security Division." The OIC for Colpetty answered on this number when we called.

For Sobitha Thero - 0777594570. "This number was given to me by the lady at Chandima Traders in Embilipitiya." He states, "I spoke to the Thero and asked him for a pirith noola which I later wore."

And for Justice Minister John Seneviratne, - 0452274140. "The number was given to me by Mr. Shashikala. So that I could call if it was ever necessary. But I have never met or spoken to him," the statement says. The telephone number for Minister John Seneviratne at his electorate in Ratnapura is 0452274142

Moratu Saman - killed before spilling the beans

Sri Lanka's regular brutal killings are no longer even a topic for debate. The killers are rarely caught while the police attribute almost every gruesome murder to that of the 'underworld' - a vague term referring to contract killers who remain at large - as did Moratu Saman until he fell victim to a member, probably from his own clan.

Gunned down by an unknown assailant, Moratu Saman had only weeks before his death, confided to a leading criminal lawyer and a lawyer not allowed politician that his life was in danger as a result of him having carried out numerous assassinations on behalf of leading politicians in the People's Alliance.

Sri Lanka's regular brutal killings are no longer even a topic for debate. The killers are rarely caught while the police attribute almost every gruesome murder to that of the 'underworld' - a vague term referring to contract killers who remain at large - as did Moratu Saman until he fell victim to a member, probably from his own clan.

One month ago, Gajan Ponnambalam, member of parliament and son of the slain Kumar Ponnambalam received a telephone call from Moratu Saman. The underworld thug did not speak directly to Ponnambalam but conveyed his wish to meet with Ponnambalam through a third party.

The go between, an individual for whom well known criminal lawyer Daya Perera and Ponnambalam had appeared, had telephoned Gajan Ponnambalam around 8.30 p.m. He told Gajan that Moratu Saman was standing by his side and wanted to come out with the whole story regarding his father Kumar Ponnambalam's murder. The gangster had however insisted he needed legal assistance before he could make his confession.

Gajan had asked who ordered the contract killer to assassinate his father? Moratu Saman had replied that the orders came from "the very high in the previous government." Ponnambalam had then asked, "Why do you now want to come out with the story - three years after my father was killed - what stopped you three years ago?"

Listening as the underworld killer spoke in the background, Gajan heard him respond saying he had strong assurances from those in the PA that he would be well looked after and guarded. He had said however that nothing had been done and he had information that those responsible for "hit jobs" in the previous government, were planning to get rid of him and all others who had carried out various contract killings for fear of details being divulged. Moratu Saman had then told Gajan "my life is now in real danger..I am certain I will also be killed."


Ready to tell story

The third party who kept up the three way telephone conversation had then asked Gajan to speak directly with the killer. Ponnambalam however had refused saying, "I cannot. He killed my father. If he wants to come clean tell him to get in touch with Daya Perera who is looking after this case on behalf of the family."

Ponnambalam subsequently briefed President's Counsel Daya Perera of his conversation and told him to expect a call from Moratu Saman.

Moratu Saman had thereafter telephoned Perera and spoken directly with the renowned criminal lawyer. Identifying himself, he told Perera that he wanted to come out with the whole story surrounding Kumar Ponnambalam's brutal killing. He however asked Perera if the lawyer would represent him.

Perera refused saying, "I cannot appear for you - you killed my friend." He however told the killer, "If you tell me exactly who ordered the killing and how it was done, I am prepared to represent you in your other cases."

Perera then asked him if Anuruddha Ratwatte or any member of the Ratwatte family had ordered the killing. The gangster had replied the question but not divulged the details.

Moratu Saman had then told Perera, "I will come and meet with you and tell you the whole story." - Daya Perera agreed. The meeting however never took place and three weeks later, on Sunday, May 18, Moratu Saman was shot dead in Panadura as he drove home.

Three months ago, an attempt was made on Moratu Saman's life in Malabe. His killers however missed and Moratu Saman was only injured in the shooting.

Highly placed police sources revealed that all evidence points to Moratu Saman being a victim of another contract killer. He knew too much and was too big a threat for various politicos who learned on the grapevine that Moratu Saman was beginning to talk about some of his exploits.

No CID investigation

His killing has been relegated to just another murder. The Criminal Investigations Department (CID) has received no instructions to find Moratu Saman's killers - instead a routine police investigation into the murder is now underway.

Previously, The Sunday Leader exposed stunning details of a taped conversation between two policemen regarding the murder of Kumar Ponnambalam. Police officer Sugath alias Shantha Ranasinghe, in this conversation spoke with OIC Nuwan Wedasinghe of the former Criminal Detection Bureau (CDB) and right hand-man to SSP Bandula Wickremasinghe, former Director (CDB).

The tape implicates a Ratwatte. In it Sugath Ranasinghe, a Reserve police officer is speaking with OIC Wedasinghe who initiated the telephone conversation on behalf of SSP Bandula Wickremasinghe.

Before this tape came into the possession of The Sunday Leader, Bandula Wickremasinghe in a sworn affidavit to the CID and Interior Minister John Amaratunga alleged that Mahen Ratwatte, son of General Anuruddha Ratwatte was involved in the murder of Kumar Ponnambalam. As a result of this affidavit being published by this newspaper, Mahen Ratwatte's lawyer, Mahendra Dias, on January 31, 2002 wrote to The Sunday Leader denying his client's involvement in this case.

Sugath Ranasinghe was the number one suspect in the assassination of Kumar Ponnambalam. In his conversation with Wedasinghe, Ranasinghe says he was let down by the cops he trusted who promised to save him by promoting him as a state witness in this crime.

Two days before Mahen Ratwatte got his lawyer to write on his behalf to The Sunday Leader, Ranasinghe in a sworn affidavit attempted to remove all blame from Mahen Ratwatte and went so far as to say that SSP Bandula Wickremasinghe "is trying to sling mud on Mahen Ratwatte for political gain."

The fact that Mahen Ratwatte got his lawyer to write to us professing his innocence in the murder of Kumar Ponnambalam, with an attached copy of Sugath Ranasinghe's affidavit also proclaiming Mahen Ratwatte's non involvement in this crime, only further implicates Mahen Ratwatte's connection to the key suspect in this murder. The taped conversation between Ranasinghe and Wedasinghe reached The Sunday Leader subsequently.

The investigation by the CID into the assassination of Kumar Ponnambalam found that President Chandrika Kumaratunga deliberately suppressed an official police report which had stated that Mahen Ratwatte, son of former Deputy Defence Minister, Anuruddha Ratwatte was involved in master-minding the murder.

The statements of former Director, Criminal Detection Bureau, SSP Bandula Wickremasinghe and his Officer in Charge, Nuwan Wedasinghe were recorded by the CID in connection with this killing. In his statement to the sleuths, Wickremasinghe reiterated that he handed over a detailed report on Ponnambalam's killing to Kumaratunga at her request, citing the involvement of Mahen Ratwatte, but that the President did nothing about the facts it held.


Planned the murder

Wickremasinghe has in the signed affidavit stated that his investigation into the murder found evidence which proved that Mahen Ratwatte was involved in planning the crime.

OIC Nuwan Wedasinghe has also said in his statement to police that a taped telephone conversation he had with one of the suspects, Police Constable Sugath Ranasinghe alias Shantha revealed that Mahen Ratwatte had indeed planned the killing.

The taped dialogue in one instance has recorded Ranasinghe telling Wedasinghe that soon after the killing, the murderers reported to "... Ratwatte."

Ranasinghe admits to having lured Ponnambalam out of his home at Queens Road in Colombo 3 to Ramakrishna Road at Colombo 6, where he was shot dead at point blank range.

Wedasinghe also told police that he is aware of the official report compiled by SSP Bandula Wickremasinghe and handed over to Kumaratunga. This report clearly states that a subsequent police investigation into the murder of Ponnambalam seriously implicates Mahen Ratwatte as an accomplice. Investigations also revealed that the son of another VIP of the previous regime had also been in contact with the killers over this incident.

The CID later recorded a statement from Mahen Ratwatte as well,and the file was referred to the Attorney General for advice. The AG has now responded stating that since the removal of the criminal defamation law, Bandula Wickremesinghe cannot be prosecuted for defaming the President.

Insufficient evidence

The AG has also said that there is insufficient evidence to institute charges for the murder against Mahen Ratwatte. The sole evidence that is available is Sugath Ranasinghe's taped telephone conversation, which cannot be used for prosecution as he remains an accused.

What may have turned this case around would have been Moratu Saman's confession. This however has now been permanently laid to rest.

Several suspects in Rohana Kumara's murder-some of whom worked directly for the PSD-have since died under shady circumstances.

Baddegana Sanjeewa is without question the central figure in this case. Formerly a bodyguard for Chandrika Kumaratunga when she was the chief minister of the Western Province, he joined the PSD after she became the President in 1994. A ruthless man with close ties to Colombo's mafia circles, he soon became the PSD's designated "dirty job" expert. Several testimonies obtained by Victor Ivan and Reporters without Borders describe him as being directly responsible for murdering the journalist, as well as a vocal Tamil lawyer Kumar Ponnampalam, and for assaulting several other information professionals. But he cannot speak up or be sentenced, because he, too, was murdered on 2 November 2001. The police found his body, riddled with six bullet holes. A PSD identification card was in one of his pockets. The PSD had dismissed him a few weeks prior to his murder. According to several sources, this provided a way for some Presidential Security Division's elite officers to save face.

Victims of several other assaults and murder attempts recognised Baddegana Sanjeewa and several journalists knew of his affiliation with the PSD. In particular, Baddegana Sanjiva had been involved in the attack on musician Rookantha Gunathilaka and his wife, singer Chandralekha Perera. The latter had identified him.

He is also thought to have participated in several PSD-ordered assaults, notably in June 1998, when intruders armed with machine-guns attacked the home of Lasantha Wickramatunga, Editor of The Sunday Leader weekly, and a smoke bomb was thrown into the Ravaya weekly's office in Colombo. Actress Anoja Weerasinghe, yet another PSD victim, stated to Victor Ivan that the inquiry into her assault had been blocked by S.B. Dissanayaka, the Sports Minister of Chandrika Kumaratunga's regime, who crossed over to the UNP camp in the 2001 elections. After being informed of the suspicious activities of these PSD elements, S.B. Dissanayaka allegedly used his influence to stall the investigation.

In December 2001, The Sunday Leader weekly published two articles implicating the PSD and President Chandrika Kumaratunga. "This is completely false and fabricated information," she claimed in a letter to the Inspector General of the state police, whom she advised to initiate an "impartial investigation."

Several witnesses assert that Baddegana Sanjeewa was about to publicly denounce the PSD's unlawful practices, which was why he was eliminated. The PSD agent responsible for killing him, Dhammika Amarasinghe, was himself murdered in January 2004, inside the Magistrate's Courts of Colombo, by an Army deserter Sirivardanage Camindakumara. Brought in for questioning by police, he was to serve as a witness in several cases implicating the President's security services.

In Parliament on Tuesday -No-Confidence Motion against Interior Minister John Amaratunga - The second day of the debate continued with the government and the opposition trading customary charges against each other. The opposition accused the Interior Minister of not taking action against those responsible for violence during the general election and the Local Government election. The government speakers focused mainly on the atrocities of the PSD and other malpractices of the PA regime during the last seven years.

Commenting on the conduct of the police in the past eight months John Seneviratne (PA — Ratnapura District) said that it had greatly deteriorated.

He said that the PA had spoken of Soththi Upali as the UNP was speaking of Sanjeewa. This he said was to no purpose.

He pointed out that there were many violations by the police to the extent that it was giving protection to unsavoury characters.

He also recalled the abduction of two soldiers by a vigilante group immediately after the elections. He said that the government had unleashed violations against PA members.

He observed that it was difficult for the PA to support the government because of its vengeful acts. "Our support is sought even as our members are made to suffer", he said.

He gave the example of cases relating to election violations implicating UNP allies being withdrawn despite the availability of evidence.

He said that in Ratnapura alone there were over 500 cases of election violence, including destruction of houses of PA allies. "The police must be instructed to take action to stem this. Apart from a few officers, the others are too afraid to do anything", he said.

He pointed out that the government transferred a number of officers in charge of police stations, violating the government’s pledge to not effect transfers prior to the establishment of the Police Commission.

He said that the police were demoralised and biased.

On the abuse of legal provision, he said that the Offensive Weapons Act was being used to arrest persons after placing explosives in their custody.

Quoting data S. B. Dissanayake (Minister of Agriculture and Samurdhi) said that the crime rate had dropped since Minister John Amaratunga took over.

He acted that abductions, arson, grievous injury, attempted murder and murder among others had all decreased since Minister Amaratunga took over the ministry.

He recalled the high-handed actions of certain police officers that went unpunished during the PA regime. He said that DIG Punya de Silva went unpunished even though he was faulted in a fundamental rights case filed by Minister Rajitha Seneviratne.

He gave the example of a helicopter tender for which Hemas had made the lowest bid. "The head of the company was detained at the request of Balapatabendi and Ratwatte. I. V. Sumanasekera was faulted in a fundamental rights petition but no action was taken.

He explained that the police had been removed from the defence portfolio to change its role in the eyes of the people. The police constantly deal with people. We want to remove the war mentality from the minds of the people", he said.

On comments on Premadasa Udugampola he said that Udugampola offered 20 policemen to the PA in 1992. It was Nihal Karunaratne who headed the group. ‘This is how Baddegane Sanjeewa too gained entry. There was a time Baddegane Sanjeewa would answer the phone if a call was made to President’s House", he said.

He added that all appointments of O/Ls was on the recommendation of Sanjeewa. "He had more powers than MPs", he said.

He said that there was an officialdom on one hand run by K. Balapatabendi and Chandananda de Silva and a Deputy Defence Minister who would not meet MPs on the other. "Anuruddha Ratwatte holds the record for not meeting any MPs in the last seven years. That is why he resorted to violence to win elections", he said.

He contrasted this with the conduct of John Amaratunga whom he said was accessible to any MP, both government and opposition. He said that it was regrettable that the no-confidence motion was being presented at a time the minister was trying to revamp the structure in its entirely.

He alleged that many members of the PA were being forced to support a motion which they don’t agree with.

Nihal Galappaththi (JVP — Hambantota) said that Minister Amaratunga is fast creating a police state for himself and is acting like the Baron in that principality. "I would like to ask the minister whether he is the minister of the Interior for the whole country or the minister for the rest of the country excluding the North-East".

He insisted that Minister Amaratunga should be banished from the country. He charged that the police force is becoming politicised and most of the police officers are working to please government politicians in order to get promotions.

Pledging confidence of the SLMC to the Interior Minister, Rauf Hakeem (Minister of Port Development) said that the entire thrust of the motion has collapsed.

He stressed that the government created a special ministry of the Interior to handle the police in order to reform the whole system. "The creation of the Interior Ministry shows a paradigm shift in the action of the police department".

He said that there is no substantial charge against the minister or ministry made by the opposition during the course of this debate.

He stressed that the Government and the Attorney General’s Department had never objected to the granting of bail to opposition MPs. "This has been the position of the Prime Minister", he said.

On the large number of crimes taking place in the vicinity of the Colombo city he said that the large number of hardcore criminals out on bail had contributed to this increase. "In Colombo Central there are 83, in Nugegoda there are 27. These people were not released during the time of this government. Many narcotics dealers in Colombo are at large. It is only the small peddlers that are arrested." He added that all politicians should desist from giving patronage to underworld criminals.

Noting that the no-faith motion was baseless Mahinda Wijesekera (Minister of Fisheries) said that the poor opposition presence was indicative that the opposition had little faith in its no-confidence motion.

He said that the minister was on a programme to restructure a police force that is on a low ebb. On incidents of highhandedness of the police, he said that it had to be understood that part of the force were a law unto themselves. "This is the case with our police. What can the minister do? Give him the space to bring about the necessary changes," he said.

On rising crime he said it was inadequate to look at it as requiring stringent police action. "We must alleviate poverty. We must bring economic development. There must also be social rehabilitation," he said.

He conceded that there were problems, but they were not condemned by the minister. "He has a big task and it takes time to set in the necessary changes. We must support him," he said.

Accusing the minister for treating questions raised by opposition MPs as a joke, S. M. Chandrasena (PA — Anuradhapura) called on the government to conduct investigations into the complaints made by opposition members.

He maintained that the discipline in the police force has totally collapsed and the police department has steeped onto such a level where the IGP is publicly arguing with a senior DIG.

He observed that if the police failed to do justice to the innocent people, they will lose confidence in the whole law enforcement machinery.

Asserting that the no-faith motion was necessitated by rising violence in the country Mahinda Yapa Abeywardena (Matara District) said that this was no personal reflection of the minister.

He gave examples of both police inaction and politically motivated action.

He said the former Chairman of the Pasgoda Pradeshiya Sabha was arrested on false allegations at the behest of a rival MP. "The policeman does this to gain the local politician’s support for the next promotion," he said.

The efficiency of the police came in for comment. He gave the example of a Rs. 0.5 million robbery, where the police who were informed of the incident just minutes after, arrived only in the evening. "They came in the evening to investigate something that happened in the morning and wanted to know in which direction robbers fled," he said.

He recalled DIG Kotakadeniya’s observation that there was a nexus between criminals and police. "If we don’t ask you for explanation, whom can we ask," he said.

Observing that the police was responsible for law and order Chandrasena Wijesinghe (JVP) said that it was acting according to political interest instead.

He gave the example of the police officer attending the opening of an LTTE propaganda in Wellaveli, Batticaloa on August 3. "He was the OIC," he said adding that his act was in violation of constitutional provisions barring the abetment of attempts to create a separate state within Sri Lanka.

"The LTTE stands for a separate state. No action was taken against the officer," he said calling for the resignation of the Interior Minister. "He must take responsibility and resign," he said.

He also gave examples of politically motivated transfers, pointing out that the pledge to not do such was broken.

He also called for a full investigation into the murder of father Aba Costa before the Interior Minister takes the portfolio of Christian Affairs.

Baddegane Sanjeewa was top security officer not allowed famous criminal during PA regime — Rajitha

The opposition presented a no-confidence motion on Interior Minister John Amaratunga citing harassment of opposition party activists using the law enforcement machinery.

However the government side maintained an edge over the opposition during the debate. They lashed out at the PA revealing many malpractice and illegal activities that had taken place during the past seven years using the state machinery.

Opening the debate Nimal Siripala de Silva (PA Badulla) charged that the UNP after six months of coming to office have begun a witchhunt on opposition members.

"Today there are countless charges concocted against opposition members to stifle their actions. There is violence unleashed against opposition activists. We are going to raise this with the visiting Deputy Secretary of State Richard Armitage and the visiting British Parliamentary delegation".

He said that the no-faith motion was presented with no personal grudge against Minister Amaratunga but for the lack of interest shown by him in bringing culprits to book in order to establish law and order in the country.

"Minister John Amaratunga has kicked the law aside and is behaving in a manner totally unsuitable for a minister. The citizens of this country are fast losing confidence in the administration of law."

Citing a case in the Supreme Court he said the court had ruled that Minister Amaratunga has violated the human rights of "sand lifters" in Wattala. He said that soon after Minister Amaratunga assumed office he had removed the existing "sand lifters" to be replaced by those favoured by him.

"The minister has gone to the extent of even violating the rights of innocent people and the Supreme Court has given a ruling against him."

He charged that over 3500 incident of violence against opposition members during the election were reported but they were not investigated. "We met the Prime Minister on this issue. Then a committee was appointed headed by Minister Karu Jayasuriya. But nothing materialised. The minister said they cannot be responsible for the wrong doing of grassroots level members of the UNP in the villages."

He said a report had been complied by a team of lawyers from the SLFP collecting all complaints during election time. That report, he said has been sent to many international lobbies.

He added that Pradeshiya Sabhas in Ja-Ela, Wattala and Atakalampanna were disrupted by government soon.

"In one instance the minister had himself interfered in the sessions of a Pradeshiya Sabha," he said.

Further, he said that the police service is fast becoming politicised and promotions are bring given not on merit but on how well police officers serve government politicians.

Countering the opposition Rajitha Senaratna (Minister of Lands) pointed out that facts and statistics are in contrary to what is cited in the no-confidence motion.

"According to the report on crime in Sri Lanka the crime rate has decreased when compared with the previous year. The number of murders and abductions have seen a 10% and 15% decrease when compared from January to June in 2001 and 2002".

He rejected any form of political victimisation in work places. "Until last week the director board of the Kalutara bus company was the one appointed by the PA regime. We were not able to change it till last week. Where does this victimisation exist", he questioned.

Moving on to political violence he charged that former Minister Mangala Samaraweera had ordered his security to shoot at the supporters of Sagala Ratnayaka during the last general election campaign. "In Udathalawinna 10 youths and supporters of SLMC leader Rauff Hakeem were murdered in cold blood. This is violence and a breakdown in law and order."

"In Maturata officers of the PSD were arrested with a large haul of weapons including a grenade launcher and with vehicles bearing fake number plates." He said that the OIC of the Mathurata police was threatened with death and called a dog by PSD Chief Nihal Karunaratne.

Lashing out at the opposition he reminded how a UNP protest in Town Hall was attacked by the PSD. "The journalists who came to cover the event were attacked and their cameras smashed. The cellular phone of one of the photographers were later found with the former PSD officer and underworld figure Baddegane Sanjeewa."

Speaking on attacks on the media during the previous PA regime, he said that Sunday Leader Editor Lasantha Wickremetunga and his wife were attacked in 1995. He said that those involved in the attack had gone back to Temple Trees after carrying out their task.

He said that people could not even play cricket during the PA regime. "Nihal Karunaratne told CID that the attack at the Board of Control for Cricket election was executed on the orders of the President. "Baddegane Sanjeewa was the highest security officer and the biggest criminal during the seven years of PA rule. ‘Satana’ editor Rohana Kumara was murdered. Was a single person arrested? It didn’t stop at that. Even the artistes were not spared. Rukantha and Chandralekha were abused and Anoja Weerasinghe’s house burnt."

He produced the application of Baddegane Sanjeewa to the post of police sergeant. "In this he has given the telephone number of his residence. When I saw this telephone number I found it familiar. This telephone number belongs to 62, Rosmead Place, Colombo 7. Then who has he mentioned as his guardian. It is Chandrika Kumaratunga".

This is how things happened during the last seven years. Prominent lawyer and my good friend Kumar Ponnambalam was murdered. The investigations are now pointing towards former Minister Anuruddha Ratwatte’s son for harbouring the assassinators.

He noted that the no-confidence motion against Minister John Amaratunga has boomeranged on the opposition. He called on the Minister to immediately bring all those responsible of criminal activities during the last seven years to book.

Focusing on the North-East conflict and the peace process R. Sampanthan (TULF Trincomalee) said that most of the issues listed in the no-faith motion have come into being due to the war that has prevailed in the country over the past two decades. "The political culture that has prevailed over the country during the last few years is responsible for the ruinous state of the country today."

He asked the PA to clearly spell out their stand on the peace process without conniving, colluding and collaborating with hard-line elements. "Present government received a mandate to find a just and honourable solution to the Tamil National question."

Sunil Handunnetti (JVP Colombo) called on the government to establish the four independent commissions without any delay. "They UNP pledged to depoliticise the police service after they came to office, but after coming to office they have created a separate ministry for the police force."

He charged that the police is used by the government to stifle opposition forces. "The police force has become a junta under Minister John Amaratunga".

Gamini Lokuge (Minister of Tourism) said that it was the UNP that launched the idea of having an independent police commission with the other three commissions. He said that the PA had objected an independent police commission when they were in office but are now talking about politicisation of the police service.

"This no-faith motion was present because Minister Amaratunga is investigating all the criminal activities of the past government. Minister John Amaratunga was appointed to carry out the investigations with a straight spine. The UNP will not stop a single investigation."

R. Yogarajan (CWC, National list) said that it is unfortunate that the opposition has brought this motion to waste the time of the house. "Those days, every month during the emergency debate we had to criticise the government even while being in the government, because our people were being harassed at checkpoints. That is not there any more. Today our people are free."

He said that actually a vote of confidence should be brought for the minister "He had done a better job than anyone in the past."

Appathuray Vinayagamoorthi (TNA — Jaffna) said: "It is true that crime rate has increased. But who is responsible for the increase in the crime rate? Some PA politicians who have an intimate connection with the underworld thugs are also responsible for the increase in the crime rate. Nearly 45,000 army personnel have deserted the army and when you investigate into every serious crime committed you find an army deserter at the bottom of it. Even on Sunday at Anuradhapura a family of nearly 6 or 7 members died as a result of an army deserter exploding a bomb. The Government and the former Defence Minister who are responsible for recruitment of personnel to the army should also be held responsible for the increase in the crime rate. The increase in the crime rate is mainly due to the army deserters.

What happened to our leader Kumar Ponnambalam? He was shot dead at Ramakrishna Road on 5-01-2000. According to the Lakbima paper of 8th March 2000 Mr. Ponnambalam had been killed by persons in the underworld with the knowledge of a powerful politician. It is said that notorious leading criminals in the underworld namely Army Ranjith and Moratuwa Saman alias Kulasinghe were suspects in this regard. It was also stated in that paper that Moratuwa Saman and army Ranjith were staying safely at a house in the Kandy area belonging to the son of a powerful politician. The son of the politician had come to know Moratuwa Saman through a police constable by the name of Ranasinghe. It is further said in the paper that the son of the politician with the knowledge of his father had given the contract of killing Ponnambalam to Moratuwa Saman through the police constable Ranasinghe. This information was available to Mr. Wickremasinghe who was the Director of CDB, who was in charge of the investigation and Mr. Wethasinghe who was in charge of the CDB at Colombo 7 and no sooner I was informed about what appeared in the Lakbima paper of 8th March 2000 I went to the office of the CDB and told Mr. Wethasinghe the OIC about what appeared in the paper. I also told him that Moratuwa Saman at that time was in the custody of Mt. Lavinia police station.

I don’t think any action was taken by the CDB. CID carried out the investigation into the killing of Kumar Ponnambalam. The investigation was handed over to Mr. Show Wickremesinghe by the President. I think this was probably done not to investigate but to cover up the activities of those suspects who were responsible for the assassination of late Mr. Ponnambalam. In this connection Show Wickremesinghe the Director CDB seems to have sent a communication in September 2001 to the President informing her the details of the investigations and the particulars of the suspects. I regret to note that so far no action has been taken against the assassins whose identities are known to the police.

Under these circumstances I should have brought a no confidence motion against the former Defence Minister who was in charge the police and the President for not having taken action. I also expect the sponsors of the so called no confidence motion to reply to matters I have referred in my speech."

Arambawelage Don Upali Ranjith alias Soththi Upali
Arambawelage Don Upali Ranjith alias Soththi Upali was the godfather of a notorious mafia gang in Sri Lankan in late eighties and early nineties.

Like many others Upali served politicians of both major political parties. Soththi Upali was a close associate of the late President Ranasinghe Premadasa and once powerful UNP minister Mr. Sirisena Cooray. Soththi Upali’s friendship with Chandrika Kumaratunga and her late husband Vijaya go way beyond his association with Sirisena Cooray or Ranasinghe Premadasa. However, it is ironical once UNP strongman Sirisena Cooray was arrested on allegations of conspiring with Soththi Upali to kill President Chandrika Kumaratunga.

Soththi Upali was shot dead on Thursday the seventeenth of 1998 at Bokundara, near Piliyandala. He was returning home from the magistrate courts in Colombo, where he has being charged in connection with the assassination of Mr. Lalith Athulathmudali. Later, the commission appointed to go into the assassination of Mr. Athulathmudali found many people including the late Mr. R. Premadasa was connected directly or indirectly with the murder.

It is believed that two vehicles have followed the bus in which Upali was traveling from Colombo to Piliyandala. As soon as he got down at Bokundara, he was shot and then dragged into one of the vehicles and taken to a place about 4 km from Bokundara, shot again and dropped. It is also believed that it is the work of a rival gang. According to the police, Soththi Upali was allegedly killed by a person named Nalin Dammika who is in the wanted list.

Police officers carrying out investigations into the killing said they were finding it difficult to proceed with the inquiry as two of the key suspects were being given cover by two prominent People's Alliance politicians. They said therefore, it could be politically motivated. "Who could carry guns in broad daylight if they do not have political patronage," an investigating officer asked. Some of the police officers told that the suspect had taken refuge at the house of a politician from the PA government.

Earlier, Soththi Upali was accused by the PA government of being used by the United National Party (UNP) to help the party in the campaign in the northwestern province. Upali has been at one time a supporter of both Mr. Vijaya Kumaratunga and Ms. Chandrika Kumaratunga, and known to them personally.

It was revealed that, during the good old days of The UNP government of president Premadas, police inspectors had to salute Sothi Upali and his criminal gang since they were closely associated with powerful politicians. An OIC of a Colombo police station had been so servile to him that the officer, out of respect for the criminal, had chosen to call him ‘Sir.’

One of Soththi Upali's accomplices shot dead

Amarasinghe Arachchige Amarasinghe alias Gawara who was shot dead in front of his residence in Horana around 1.00 p.m. on Tuesday May 22, 2001 is suspected to be one of Soththi Upali's accomplices.

According to information from the Horana police, he is suspected of being a member of the underworld gang, which specialised in contract killing.
The Horana police believes Gawara's death was in retaliation to a suspected contract killing he had carried out and over which a court case is pending. A number of other murder charges have also been filed against the deceased. The Horana police say they have reason to suspect that Gawara's death was itself a contract killing.

According to Gawara's wife Somalatha, who was the only eye-witness, two persons she identifies as the children of one of Gawara's alleged victims, had arrived with guns when Gawara was leaving to work in his tractor and shot him in the head. The tractor had overturned and fallen on the deceased.

Amarasignhe was a permanent employee of Perth Estate, Horana as a security guard for the past twenty years. Somalatha was threatened by the two gunmen who had told her not to interfere in the matter.

Mohamed Faizal alias ‘Faji’ who was wanted by police for his alleged involvement in many crimes in Maligawatta and two others were killed in a crossfire between police and gangsters last morning, police said. Fajji had forced many women in the area to have sex with him. "No one could have rejected him. He had any woman he desired," he said asserting that he could not have survived without the patronage of influential politicians representing both major parties.

‘Fajji’, one of the most politically influential gangsters in Colombo, was killed in a shoot-out on the roof of a three-storeyed building in the Maligawatte police area by an STF SWAT (Special Weapons and Tactics) team yesterday.

Acting on information obtained by the STF Intelligence, the elite police commandos had cornered the underworld leader and two of his associates and gunned them down.

With the war against the LTTE coming to an end, the STF had increased its presence in the city and its suburbs.

Addressing a press conference at Police Headquarters yesterday, Police Spokesman Senior DIG Nimal Mediwaka said that the raiding party had recovered two T 56 assault rifles, about 60 rounds of (T 56) ammunition, one CZ pistol, five hand grenades and two mobile phones. Dismissing allegations that the police had executed persons linked with the underworld, thereby operating outside the boundries of the law, Mediwaka emphasised that the police were only acting in self-defence.

IGP Jayantha Wickremaratne said that President Mahinda Rajapaksa and Defence Secretary Gotabhaya Rajapaksa had directed the police to wipe out the underworld. The police chief said that Fajji and some of his associates had returned to the area believing the police had suspended their operations against the underworld due to recent police excesses including, the killing of two youth at Angulana and the involvement of SSP Vas Gunawardena’s wife and the son in an abduction and assault case.

The police chief said that Fajji’s gang had been involved in killings, extortion and the heroin trade as well as many other nefarious activities.


An STF spokesman told The Island that Fajji had operated from several houses in the area and at the last elections for the Western Provincial Council was regularly seen with a ruling party candidate. In fact, the candidate had set up a party office at one of the luxury houses owned by the gangster in the Maligawatte police area. Responding to our queries, he said that commandos had also detected a hideout located at another place in the same police area. He said that the entrance to the air conditioned room which could comfortably accommodate about five persons was through a pantry cupboard.
